Matilda Terry ... she is the wife of Whit Terry The Deceased, that they lived on the Plantation of J. K. Corley in Edgefield County, that on Monday morning a croud of white men came a long the road through the field where Whit Terry and witness was. They had Whit Terry's Brother a long with them. Whit Terry was standing in the road near George Terrys house and the white men was going a long a road that crossed that Whit was standing in not far from where Whit was standing. Whit had two double barrel shot guns in his hand, and his little haver-sack swung around his neck with powder shot and caps in it. The white men told Whit to put down his arms, he said he would not for he had done nothing. They again told him to put down his and he still refused to do so, and then the white men fired on him. Whit then raised one of the guns and pointed it at the croud of white men droping the other gun on the ground do not know whether or not Whits gun fired does not know who shot first as there was so much fireing on at the time, after Whit pointed his gun at the white men He turned around and run off and some of the white men followed him, witness heard no other shooting after Whit run off. Whit knows some of the men that was in the croud ... does not know what the white men were after, they had searched Whits House on Saturday for a stolen hog ... the next time Witness saw Whit after he run off he was lying in Watt Petersons pasture near his spring dead ... Witness never heard Whit make any threats against the men that searched his home

George Terry was with the white men.

George Terry said that he did not steal the hog bu-[?] could tell where Whit [or it?] was if he would but did not want to have any thing to do with it and on Monday morning Witness and others met at Mr Corleys to make farther search for the hog, they got George Terry and started out for George Terry to show them where he thought the hog was, in going they had to pass through the farm of Whit ... when the party got opposite to where Whit was he hailed the party and started towards them, saying God damn you if you are hunting me here I am, he had two double barrel shot guns in his hands, some one in the croud told him to stop or put down his guns he did neither but when he got in shooting distance ... he fired at them ... several of the croud fired at him after he fired at them ... The croud had not interfered with Whit, neither had any intention of molesting Whit if he had not hailed and fired on them first.
