Jack Templeton, being sworn, declares that in the evening of the 20th October 1870; at about 3 P.M., Abe Simmons came to house of deponent, that Abe went to bed in deponents house that night; that two men came into deponents house and called for John Templeton, deponents son, that the men said, "make up a light," that deponent made up a light with a torch, that the men aforesaid found Abe Simmons and took him out of deponents house; and that deponent heard shots fired soon after and heard Abe cry "O Lord, have merct on me," that when the men were taking Abe out Able cried "Massa John let me get me my clothes" that soon after the firing deponent left his house and came back next morning, heard three shots fired deponent went back next morning about sunrise; found Abe lying on bed shot in body, that Abe told deponent "I'm shot" that Abe Simmons told deponent that Jim Dillard and John Ramage shot him that Abe was not fully conscious at the time...
