Dave Gillam was going up the road near near Jerry Perrys house and Said he had to go home and take up his fodder. I told him to go Stright on home and he Said Just as quick he got his hat and then he Started back down the raod to get his hat & he got about 50 yds from the road from where we were talking and me Eliot Johnson & Dave Grabed at Eliot hat. Eliot Shoved him off & Says god dam you I will Kill you & then drew out his pistol & shot three times
