he then walked up to Murrell and caught hold of the pistol and told Murrell to give the pistol up he refused to give it up witness made and effort to get the pistol from Murrell the pistol then went off in the hand of Murrell while witness was also hold it that deceased then spoke said Mr Jones he has kill me
