I have examined the body of Mack Kirkland the deceased and find that there are two wounds. One in the left side, as light wound, which in my opinion would nto have produced death. The other wound was in the left side of the chest, entering between the fifth and sixth ribs, about three inches below the left breast or nipple. I believed that the ball producing this wound entered or passed through the heart, causing death. I believe the wounds were from a Pistol. T. W. Salmond, M.D.

Dr. E. M. Boykin sworn. I was standing at M[?] Corner, saw Killz and deceased talking, saw Killz dismount. there were three shots fired. I saw them engaged in conflict. I think the first shot missed. the third shot I think caused death. I did not hear the conversation. no blow was struck that I saw before the qst firing by the deceased. Elder M. Boykin

Hardy Kennedy sworn. I was within five steps when it took place. Mr. M. Cloud, John Lyles & myself was standing in the door. deceased come by and raised the horses head, which was over the pavement so he could pass, the horse having turned round on the pavement. Killz said that is my horse, and you must look out or I will put you through. deceased said I can't go through your horse, and he ought not be on the pavement. Killz says I got penty from you. deceased said if you have anything against me, get off your horse and here am I. if you are the hostler I am the rider. Killz got off of his horse. he then went to deceased and fired his postol. I heard two shots. after first fire deceased struck Killz with a stick. I think he struck Killz twice. Henry Pate sworn. I saw Killz ride down the street on a horse, and leading another. he rode up in front of Cloud's store on the pavement. after few moments I ehard loud talking, saw Killz alight from his horse. when he light he drew a Pistol, going woards a colored man, he got close to him and fired, then the colored man raised a stick and struck Killz then fire twice. The colored man sank then to the ground. H. Pate.

J. M. Cloud sworn. I was standing in my store when Mr. Killz rode up. I saw him in front of the door. he rode his hoses up on the pavement. his horse's head was near the store. deceased came along and caught hold of the reins of the bridle and pushed the horse's head aside and waked fast. Killz said go on I dont want to hear any more of your Jaw, or something to that effect. the deceased kept talking and said something about I am your rider or something to that effect. Killz was talking to myself and Lyles, dont think he heard what deceased said. deceased repeated it again and Killz heard it. Killz got off of his horse, drew his pistol, walked right up to deceased and fired. think it passed on the rigth side, don't know whether it struck or not. The deceased then struck him across the head with a stick, cant say how many times. Killz then staggered back, that is the last I saw. I ehard two shots positively. Killz was in liquor. after the first shot I heard I walked back inot my store. saw nothing more of it. J. S. Cloud
