CLYDE MASSEY, DULY SWORN, TESTIFIED: . . . Q. How many times did he shoot? A. I think it was twice. Q. Go ahead and tell the jury about the shooting. A. After Herman came up he got out and went around the car, behind it, some boys went out where he was he came around in front of the car and shot one time. Q. Where did that shot go? In the air. Then he went up on the porch and Albert came to the door and asked who shot. Herman told him it was him. Albert backed up and Herman shot. Q. How many times? A. I know he shot once. There was more then one shot fired but I don't know who fired it--I don't know whether it was Herman shot the other time of not . . . Q. What caused this trouble between Albert and Herman? A. I don't know. Not anything that I know of . . . Q. Was there much drinking going on? A. Not that I saw of?
WILMA BOYD, SWORN, TESTIFIED: Q. Tell us what you know about the shooting? A. Herman Massey drove up down at Albert Blakeney's house, got out of the car and started to the house. Albert said, "Who in Hell are you?" Herman said "Why?" Albert throwed up end shot . . . Q> did you say anything to Albert? A. No, he was saying, "Oh, Lord, I'm shot, Oh Lord, I'm shot." Q. Did you see anything in his hand? A. Yes, he had a pistol in his hand . . . Q. Was Herman drinking? I don't know. Q. Was Albert drinking? A. Yes.
DR. D. C. GRIGGS, DULY SWORN, TESTIFIED: Q. Did you examine the body of Albert Blakeney? A. Yes, I treated him -- it was about midnight or later, Saturday night when they brought him to my office, then I saw him again today, his body, I mean. Q. Did you tell him he was going to die? A. Yes, but he didn't agree with me. Q. Did he say he wasn't going to die? A. Yes, he said he wasn't going to die. I told him he was going to died and if there was anything he wanted to say -- make a statement of anything -- he'd better do it. I examined him and found that the bullet went in a little to the left of the _____, the lower left rib, went through end stuck just under skin. I asked who shot him and he said it was Herman Massey. I asked him if he had a gun and shot it. He said he did, and shot one time. I asked him if he was drinking and he said he had a drink. I didn't find out as to why the shooting occurred . . .
