First Witness: Silas Johnson, while, Duly Sworn, testified follows: The shooting took place at Mr. Gulledge's house between eight and nine o'clock on the morning of November 23, 1940. I shot him with a 38 automatic pistol. When me and Mr. Gulledge traded we made an agreement that we would settle ever Saturday for the work done during the week. I haven't worked in about two weeks but my children have been picking cotton. They went for the pay, Gertrude and Martha Johnson. Mr. Gulledge wouldn't settle with them. He told the children to come back and tell me that if I wanted the money that I would come for it. If I didn't want it to wait awhile. I didn't know anything to do but come and get the money. I needed the money. I went up to Mr. Gulledge's house and tried to settle with him. He had a piece of paper with the weight of cotton on it, 202 lbs. I asked him if that was right. I checked over it and found that it was more than that. Mr. Gulledge had made a mistake. We didn't argue about the weight. Mr. Gulledge commenced about when was I going to move. I had been trying to get a place for two weeks, trying to find a place to move without having to trouble Mr. Gulledge. I had been informed that Mr. Gulledge wouldn't deal with me right. My boy, Carle, came up while we were talking. He had something to say about that if Mr. Gulledge owed him that he would pay him. Mrs. Gulledge got a stick and started after Carl. She hit him two or three times on the leg. I asked her two or three times not to hit him hand. Mr. Gulledge came out after me. He didn't have anything in his hand. I was afraid that he was going to shoot or cut me. I started to run and him right after me. He looked like he meant to fight very much so. I was afraid that he meant to fight. I knew that he could outrun me so I turned around and shot him. Mr. Gulledge was facing me coming toward me when I shot him. I was expecting sudden death if I didn't shoot. . .
