FIRST WITNESS, ROSANNA BROWN, DULY SWORN, TESTIFIED AS FOLLOWS: . . . While I was in the back yard I heard a noise. I asked why Peter was making such a noice. Who was making the noise? "Earnest Howard and Eva Funderburd McRay." I told them I was going to send for the Policeman. Peter was beating Eva McRay. I got them quieted down then. So, David Primus came across the street. He told Peter not to hit Eva any more so I told them if it kept on, I was coming after the law, so they quieted down and Peter went home. . . So Peter come back across the street. David come back across the street. . . I asked Peter Howard why he was making so much noise, he said he was going in the army Monday morning. So Peter said if they lock me up, they would turn me out Monday morning That was Peters third trip across the street. David Primus did not make but two trips. He didn't go back until he was shot. SECOND WITNESS, EVA MCRAY, DULY SWORN, TESTIFIED AS FOLLOWS: . . .I was in the kitchen and another girl that lived with me was in there curling hair. Peter Howard looked in and looked at me and rolled his eyes at me. In what condition was he when he came into your kitchen? "He was drunk" How did he smell? "Smelled like liquor." Then I started up town, just as I got to the Duvall Road, Sister came and called me and asked what was the matter and Rosanna Bridges passed while I was talking to Sister.
