Shell by a shot gun or musket shot on the second day of Nov 1868 near the residence of his father H R Shell against the peace and dignity of the State afore said.

W.D. Barksdale and Robert H. Hudgens being suly sworn, saith, that on the second day of November 1868 they together with Clinton Shell, G.A. Barksdale were riding the road near Henry Shell's, and at the fork of the road above the house of the said Henry Shell, we were fired on by an unknown party supposed to be some eight or ten. At the first fire Clinton Shell fell from his horse, the party that fired were concealed behind the fence and some brush wood...
