Harriett Earl freedwoman wide of deceased is sworn and testified as follows, at a late hour of the night of Suunday last two white men rode up near their house called them up wanted something to drink they had none. Wanted to know if that was Elias, he answered in the affirmative wanted him to come out they wnated to talk to him Elias refused to go out that they could talk to him where he was. Elias made up some light the two men came in the house still spoke of wanting something to drink and in a little while one of them drew out a Pistol and fired some four times. Elias ran around the room & through the partition door & up stairs, these men went out & rode off up the hill towards Boyds house. Elias died from the effects of the shooting yesterday evening, that deceasd stated to her that he believed that it was Brown who shot him.
