Payton Parks sworn says, that on yesterday afternoon, the 17th January 1828, he was at work near the stables, when John Meador came to him, and made some remarks to him about his work, and enquired of him oif the Rifle was loaded, he told him not the deceased said he saw a Hawk on the fences as he came along and wanted to shoot it. Decesd went to house, and got the Gun and called to the deponent to know which shot bag belonged to the Rifle... Decsd. had left him about 8 or 10 minutes when he heard the report of the Gun behind the barn. It produced no alarm in witness mind, supposing he had shot at a hawk or bird, about this time witness went to the house to dinner... Found him lying on his back his Hat off near his head, his right shoe also off and lying by him the Gun was lying in his arm with the muzzle towards his head and near his chin...
