William Simpson being duly sworn that he was standing in the back door the child in his arms and pistol in his hands and while attempting to revolve the barrel to move the loaded barrel from the hammer he cocked the pistol and while revolving the barrel the pistol accidentally fired the ball entering the the right eye of the child passing through its head killed it instantly.
