W.H. Henderson being sworn says I was at Ella Nelsons house on the 29th day of July 1894 about 5 o'clock. P.M. I walked in the house and saw Will Simpson standing about nine feet from me. I asked him what he was doing here, he at once in a very savage manner rushed upon me, catching around my neck with his right arm... I told him to let me go, that I would not hurt him, he forced me to the back door and we fell outside... he immediately arose and returned towards me with his right hand in his hip or pants pocket, I again told him to let me alone... I then shot him with a No. 38 caliber pistol one time, because I considered my life in danger, as I had heard of threats against my life made by him, and I knew him to be a dangerous man.
