Testimony of John M. Beaty--Sworn says--That he was prsent in company with Jeremiah Benson, (Called J. M. Benson) and Irving Stallings on the third day of February last when Benson and Stallings and himself got to Bensons House two Negroes was stadning in the yard, when Stallings got out of the Buggy, the two Negroes ran, around the house, Stallings run after them and caught one of them, and brought it back to where himself & Benson was in the yeard.--Stalling asked Benson to hold the Negro Girl, to which Benson refused, Stallings then asked him to hold the Girl, he took hold of the Girl, by Benson request, Benson, asked Stallings, if he wanted a string to tie the Girl, to which Stallings replied yes, Benson says I will give you one, immediately Benson shot Stallings with a Pistol. Benson said I can do it again if you want it done, Stallings said Beaty I am a dead man Lord have mercy on me and then fell. Benson said to him, help me to carry Stallings into the House. Witness imediately left, further states that Mrs. Benson was not Present. John M. Beaty
