Chas Muse Sworn. Say that Last night as he Capt Andrew Feaster Capt. Aromanor Liles and Henry J Macon, and C. Woolley was in pursuit of Shadrick Jacobs in order to apprehend him as a States Prisoner, that They had Left the House of Jacob and Were going to the House of Randolph Woodward where they supposed Jacobs was. That after they got on[?] Jacobs field Capt Feaster Hailed some Person - that immediatly a gun was fired and Feaster fell, that he saw some person get over the fence[?] but did not see any person before the gun was fired, That Capt Feaster after being shot Said He was a dead man, and that he thought it a Hard Case he should be Killd by such a man as Jacobs. Then[?] Mrs. Jacobs was found near at the time, of firing the gun, That he Took Mr. Jacobs and demanded[?] her name, that she refused to tell her name for some time and then said her name was Morgan, and did not own[?] her name to be Jacobs untill C. Woolley Came and Knew her, that She appeared to be in the act of going off after the fire of the gun ------ Henry J. Macon Sworn, Says that he was at the House of Jacobs in Company with Chas Muse Capt Liles Capt Feaster and Oyekeel[?] Woolley aiding the said Muse to aresst Shadrick Jacobs, that soon after they Left Jacobs House, a gun fired, that Capt Feaster fell, that he Came up to him and asked him What was the matter, that Feaster Replyed and said Should Loose his Life by that infurnal Rascal Jacobs and that he expired soon after------- Capt Aromanor Liles. Sworn, says that he was in Company With Mr. Muse and others. near Jacobs House, That Capt Feaster was Shot but Deponent Could not tell when he was wounded untill he got a light, that he was Shot near the [?] of[?] which wound he soon after died-------- Thomas Nelson sworn, Says that on the 5th of this Inst Shadrick Jacobs was at his House and and had a gun, that the Deponent asked Jacobs if there was not a Search warrant against him, he Jacobs replied and Said he had heard there was, and that he would not be taken-------- Randolph Woodward Sworn Says Jacobs and his wife was at his House Last night 5th and had a fun, that Jacobs Told him he wished the Said Woodward to go over in to Newbury[?] to Settle some Business he had to Settle there. That Jacobs Borrowed his gun to Kill a Hawk that he left his[?] House some time in the night that Soon after Jacobs and his wife left the house he heard a gun fired of, and Some Hollering that on the morning of the 6th His wife brought his gun home, that She told him Capt Feaster was Wounded. that he was at the House of [?] [?] in the evening of the fifth and saw [?] Mr. Muse Capt Feaster Capt Henry Macon, and That he said[?] Jacobs of these Men being at Woolleys. deponent on [?] [?] [?] the Guns! (appears to equivocate) by first sating that Jacobs Left the Shot Gun when he borrowed the rifle in middle of the day. afterward said Jacobs took both Guns with him. and then that Jacobs Wife took one of them. afterwards said Jacobs carried away both Guns in the middle of the day. that in the evening he rbought them back with him and when he left his house at Night took both guns with him. James Nelson Sworn. Saith that when Jacobs left his house at night to go to Randal Woodwards house. the said Randall Woodard was with him and that they went together. Mr Woodard Sworn Saith that Shadrick Jacobs came to their[?] house yesterday about noon, and borrowed a Rifle Gun of Randal Woodard to kill a hawk, that Jacobs Returned with his wife at night with two Guns, and after spending the evening at late bed time both Jacobs and his wife left the house to go home, and she [?] Jacobs tok both Guns with him, that a few minutes after she heard the report of a Gun, and the cries of some person in distress, but neither She nor Woodward went to the place, that early this morning, the deponent started to go to Jacobs House and on her way saw two hatts[?], one of which was Jacob's hatt[?] and a Rifle Gun, which she knew to be the same Woodard lent jacobs yesterday, on proceeding to the house she saw Ephm Morgan &[?] wife. James Fair, and James Nelson, on her asking who was killd last night, Morgan's wife replied Capt Feaster and she expected her father killed him. [top of document damaged] aforesaid do further say that they believe Randall Woodward, was aiding and abetting in the aforesaid murder, by Sending and delivering to the aforesaid Shadrick Jacobs the Rifle Gun aforesaid.
