FIRST WITNESS: Lottie Mae Clyburn, duly sworn, testified as follows: It all started about some pigs. . . "Tooting" came after the pigs Sunday morning. Bud had brought them from him and hadn't finished paying for them. "Tooting" came to the house and asked for some bread to give the pigs so he could catch them. He couldn't catch them with the brad and he said he would shoot them if he couldn't catch them. He took the slop buck and caught them. . . He put them in the car and started to drive off with them. Bud and Mr. Plyler came up and Bud jumped on the car to get the pigs. Q. . . Who did the pigs belong to? A. Bud bought them from "Tooting." He hadn't finished paying for them. I was so excited I don't know that happened. . . Q. Was Bud, "Tooting" or William Clyburn drinking? A. I don't know. I don't pay any attention to drunk men. . . Q. Did you see who had the pistol? A. Mr. Ike had the pistol. I was so excited I didn't hardly know what was going on and I was trying to keep my children back. There was such a wrangling going on out in the road between Bud and "Tooting." Q. Did anybody else have a gun? A. "Tooting" had a gun. . .
