JOHN C. MCLAUGHLIN: . . . I had just put the car up and went in the house and was getting ready for bed and in a few minutes I heard Mr. Funderburk, who lives next door, call and I dint know what the matter was. Mother called me and I went out where (Mr. Funderburk) was. Stewart wanted to know if I had a flashlight and said someone had been over to his house so I went back and got the flashlight and went back. He looked around the yard of the house, thinking there might be a drop or two of blood. . . We went to the front of the house and couldn't find anything, so we decided we may as well go on back to bed. I walked on back to my house and went in the back door and had the flashlight. I turned it toward the Maynard home and saw a form lying in the grass right near the fence between our house and Mr. Maynard's house. . . He and myself turned the light on the body and saw it looked like the person was dead. . .
MRS. M STEWARD FUNDERBURK SWORN: . . . I went in to take a bath and after I was in the tub, I heard a noise that sounded like little Steward jumping on the bed and looked in his room to see and he was asleep. I went on back and get in the tub. I heard the same nose and for a few minutes it didn't even register with me that this nose was not in my house, out on the window just outside. As soon as I went on listening I knew it was somebody trying to get in the house or at least prowling around the house and I woke big Stewart up, and sent him out to see about it and he had just gotten out and it seemed to me had been out maybe four or five minutes -- I couldn't judge time, I was afraid -- when I heard Stewart make tow sounds. It sounded just like a ground like somebody had knocked him down and then the bullet shots. I immediately ran and called the police
