Nora Brown, witness, duly sworn, testified as follows. . . I was sick & was in bed at the home of my Mother Connie Brown. Walter Brown left the home to go to the store (Charlies) to get something for breakfast, and stayed such a long time until Mose McKay came by and told (I) told him to go get my breakfast. He went to the store of Charles McClellan and Mose got a can of peaches and was sitting on the bed beside me when Walter Brown walked in the front door with a butcher knife in his hand, cussing and Mama 9Connie Brown) said if he didn't stop she was going to get the law to come and get him, and said if you do you have better not be here when I get back. Mama said she would leave if he was going to treat her like that, and he said he would such, and to go fix him something to eat. Mose McKay said that is right Walter, be a good boy. Walter walked toward the front door and Mose went to put the bowl back in the kitchen that he had been feeding me peaches out of. Walter grabbed an ax that was sitting in the corner of the front door, and started toward Mose for him to run, and besides, Mose was backed up in the corner of the room and Kitchen Mose grabbed a gun that in the corner of the kitchen, and said, don't come on me Walter do I am growing to shoot you. The gun was setting in the corner and Moe reached and got it. . . . They had no trouble before that I know of. I hadent seen either take a drink the day of the shooting. . . .
Bert Henry, witness, duly sworn, testified as follows. . . . I stopped by Chapmans drug Store in Cheraw, and Walter Brown was in the Drug Store buying a can of Can Heat, and we came out together, and went in Charls pace, where he bought a soda o mix it and drink it. I went on home, and do not know where he drink it or not. He came later and was standing in front of my house, and close to Moses house, cussing, and I told Mose if I were you I would tell Walter to go on, and not be cussing around here. . . walter said I will go, and walking off, said all of you S.O.B, can kiss my ass . . .
