First Witness Dule Sworn Testified as Follows John A. Anderson I am the owner of John A. Anderson Store in Chesterfield County, Cheraw, S.C. Sunday morning April 17, 1943 I hired Wallace Turner to guard my store, as it had robbed twelve or more times recently. It had been robed five times in les than six weeks time. The Chief of Police Mr. Earnest Womack of Cheraw, S.C. fired Mr. Wallace Turner with me, and Mr. Womack and myself were paying him half each of what we agreed to pay him to guard the store and catch the robber. The store door was left open each time after robber there was no other key to the store that I knew off.
Fifth Witness, Wallace Turner, Duly Sworn, Testified as follows. Mr. Earnest Womack, Chief of Police of Cheraw, S.C. hired me to go to Mr. A.Anderson Store and watch it is some one was going in the Store at night., and said if any one broke in to keep him in Store until he came . I went in the store. . . and fixed me a hiding place near the front door. I sat in it about one o'clock some one came to the front door, which was the screen door, and pushed it back, and unlocked glass door, and came in. I let him get three or four feet toward the counter from the front door. I threw my Flash Light on him, and my gun, when I halted him. He whirled around and struck my left shoulder, knocking the flash light out of my hand, and struck me a glancing blow in the face, and the grabbed me around the neck. We wrestled around for a minute or two, and I saw he was getting the best of me, an old man, and I tried to shoot him in the leg, ans shot the front glass out of the store trying to stop him. I threw my gun over his left shoulder and shot him once, and again, as fast as I could pull trigger of my pistol. The I went to the door and to the house across the street to get some one to get a Doctor and the Police. . . .
