Mr. O. T. Davidson: . . . Horace Crould and myself had been down the street. We got half pint of whiskey and were going to the cafe . . . I come in the back and Leroy Allen, Horace Crould and myself took a drink. We went back and started shooting poll. . . Evans came back in and said there was a boy wanted to see me. I went out to the car. Ira said, "Lets go Robert" and he said he couldn't go. About that time I saw a girl going towards the Bus Station, this kinda fat girl was with her. The fat girl was talking to a solider. When I got there, this soldier was teasing the little girl. I caught the girl by the hand and asked her for a date. She said she had one with Durwood. Durwood and William Graham came up behind me just before we go to the other end of the Bus Station. Evans and Ira came across the street. We all met there together. The girl called Durwood off to talk to him. I started with Durwood, and he told me to go back, so I went back. Ira had the magazine of the pistol out. . . He was playing with it. William Graham said for me to get out of the way, and I moved and Ira turned the gun back around. At that time Durwood called me, so I was sitting right in front of the Bus Station with him. . . We heard a gun go off and ran back when we got there we ran for a doctor.
Mr Melton . . . I found Ira Boan, Jr. and I asked "Ira how come you shoot him?" and he said, "It was an accident." I asked him if it was an accident, why did he throw the piston away, and he said that he didn't know what he did with the pistol. He began crying and praying that Evans wouldn't die, and he continued till we got to Chesterfield. . . . Sheriff Douglas: Do you know where the pistol was found? Mr. Melton: It was found in the used car lot, about in the middle.
