FIRST WITNESS: ELOISE DAVIS, DULY SWORN, TESTIFIED AS FOLLOWS: I was in the car that she got out of and when she got out she went around the back of the car and ran out in front of this other car I did not know who was driving this other car. Mr. Fred Miller was driving the car that she got out of and the one I was in. Mr. Miller stopped on the side of the road. There was a mail box at the road, right across the road was the drive way up to the house. Pat Rinson, Tot Eddins, Dinky Eddins, me and Mr. Miller was in the car. Mr. Miller did not get out of the car before it happened. We had been riding in that car for two days. I am eleven years old. That car was meeting us.
SEVENTH WITNESS: ROBERT LEE SLITS, DULY SWORN, TESTIFIED AS FOLLOWS: I was driving the car. I was seventeen the 22th of July. I stay about a mile from cousin Rob. I was coming from down the road and there was a car coming along and I though the car was going to turn so I slowed down. I went to pass and just as I went to pass the little child run out in front of me. I slowed down. I stopped and went back. I was driving 30 or 40 I did not tell anybody was driving between 40 and 30. I slowed down. I was driving about 40 coming down the road. I was driving about 20 or 23 when I hit the child. I don't drive reckless.
