He sat there until we finished supper and then we walked out on the porch. . . Mr. Tiner called me out on the front porch, said he had something to tell me. He asked me if I wanted a drink. I told him I did. . . . My wife called. I went in to see what she wanted she told me to come on in and maybe he would go home and we would be rid of him. He came in the house and walked back out on the porch . . . I walked back in the house and was pulling off my shoes and my wife said she was going to get a drink of water. She went into the dining rom and got the water and must have turned around to come back. I saw the blaze of the gun and I hollowed. There wasn't but a few second between the shots. I made a start to the door to go into the room and saw her fall towards me, when I saw Mr. Tiner his hand was over the gun . . . Q. Was he drunk? A. No, but you could tell he had been drinking . . . Q. Had he said anything at your house about shooting anybody? A. He said something about killing himself . . .
