I hereby certify that I attended John Gary Baker (col) who was brought into the Good Samaritan Hospital . . . as a result of a gunshot (probably a .32 cal bullet) wound of the left lower chest and abdomen . . . L. E. Fleming, M.D.
Thad McCaskill (Col) Sworn --- Sunday July 19 1936 at Walter Jowers house in Chesterfield County, John G. Baker came up here stayed 30 minutes -- Dave Sowell started around house John Called him Dave sad don't call me John and Dave Sowell were arguing I dont know what about. They fought in edge of yard John Gary caught Dave around neck first, trusselled awhile, Leroy Baker carried John up road in car, John cussed when leaving house. I didn't see any knife or pistol of whiskey
Hettie Jackson --- Dave Sowell & John G. Baker quarrelled in yard and we got them in Leroy Baker and John opened door of car and got Dave Sowell around neck they separated them. I smelled whiskey on John G. Baker. I dont know where Dave was drinking or not. John came back about 7 o'clock, child came in kitchen told me John was out there he had his ha in his pocket said he wasn't treated right & wan't going to stand for. Leroy Baker said he was going to send him away. John ran up road with hand on hit. I heard Walter ower hollow Boy don't come on me with that knife several times Walter Jowers was moving back & then Walter shot him one time. Walter com on to house. Said he had shot him. Walter hadn't any troube that I known of. Walter told him to leave house when they had the trouble the first time . . .
Dave Sowell --- . . . I didn't see him any more that day he looked like had a drink or two
Estridge McDonald -- . . . John spoke to me I said hello John. He said stop here Mr. Walter I want to see you a minute. Walter went with him about 8 or 10 steps. John cussed Walter. John pulled knife out right hand pocket it was open Walker told him I can't talk to you with your knife open -- Walter asked him what was the matter what had he done John cussed him again Walter jumped back. John was going toward him with the knife --- He wanted to know what sort of G. D. way he had of trating him Walter said I aint bothered you Walter jumped back & pulled out his pistol . . John told him the G. D. thing would shoot him. He told John I dont want to shoot you John told him to the G. D. thing wouldn't shoot to shot Walter shot him in Blue Steel pistol I don't know what kind we came on to house. 1 shot fired. They were 8 or 10 steps apart when he shot him. I was on opposite side of the raod from them I don't know where either were drinking or not.
