Gillespie McKenzie sworn -- Jonnie & Claude McKenzie came to my house they were nearly drunk I had gone to bed about 7: 30 P.M. I opened door for them they went out & got some whiskey in a cup (Claude) they kept drinking tired to get me to drunk some. Told me whisky was out beside a tree. I did not drink any thing. Claude leaded up against lock of bed & layed back on it, told me he wanted to show me something pulled out them things (Rifles) I told him to put them back in pocket I had a friendly time If he couldn't do any better to leave. Jonnie was settling down & said they were good to make C C pills out of goat pills. I told him to get on out. Jonnie went to front door & went out Claud went to get my gun. Gun was loaded with no. 4 shot. I beat him to gun I run back to door. He started on me. I had gun he didn't have anything in his hands. Jonnie said Goddamn him catch him & we will kill him I told Claude if he came on me I would shoot him I said get out now & don't come any further when I told him that again he started on me then I shot him. He was holding his hands out away from his sides nothing in his hands he was aiming to talk gun and kill me. I was about 6 or 7 ft from him when I shot him. . .
Sheriff Douglas sworn says -- . . . Gillespie McKenzie . . . stated to me in presence of Eugene Stanly that Claude & Jonnie McKenzie his brothers come to his house at night of Jan 29 & Brought about 1 pt. of whiskey. He also states that the three were drinking together that he took 2 or 3 drinks.
