Norman Robinson: . . . Brutus Cagle, Leroy Boan. 4 or 5 shots were fired before Leroy Boan was killed. . . Brutus Cagle, his wife and children, Leroy Boan and I were only ones there. My wife and boy had a wheel. Boy laid wheel down side of road. Brutus' children found it. Last Thursday evening my wife and children to carry paint to Brutus' home. She heard Brutus' wife. While they were there my boy found his wheel. He told his mother "that's my wheel, I'm going to take it home." She said, "allright." He walked around house wheel in hand. Brutus walked through house, wrung wheel out of my boy's hand, slapped him down twice. My wife got up, walked through house and told Brutus -- "don't be slapping and beating my children around, you have no right to." Brutus said "Get out of my yard, you God Dam Bitch you." She said "I will get out and I can stay out.: He walked on out into field. He said "God Dam you, don't be standing around my house." She was on her own premises then. The line is about 15 yards from Brutus' house. She said "I'm out of your yard and premises and I'm going to stay off." She walked off in field and sent one of the boys after me. Boy came to Mr. Luke Mills'. I was building wagon shelter. He said "Daddy, Mama wants you to come over there." I went, and she was in the fieldfeild about 125 yards from Brutus' house. Will Brewer was standing there talking. Will Brewer is the man Brutus works for. I said "What's the matter now." She said "Brutus has threatened slapping me down and slapped James (my boy 10 yrs. old) down twice." "He slapped him down about wheel colored boy gave him the other day." I walked over to edge of field told Brutus "What you mean slapping my children around. You have no right to. If they do anything to you tell me and I will whip them. That's my job, not yours." He said, "God Dam your soul, get away from this close to my house to talk to me any such way as that." He picked up his axe and walked out to edge of his yard. He didn't walk toward wood pile after picking up axe, he walked north. I was on Luke Mills' land. He was on Will Brewer's land. He drew axe back and said "God Dam you, I'll kill you." . . . I said "If you feel that way, come on." He dropped axe down beside him. . . So me and my folks went on home. I went to work Friday same time. He came and took papers from me and my wife. Monday A. M. about 10 a.m. Mr. McManus (constable) cam and notified my wife. He told her "Brutus took out papers for you and Norman." He said, "Tell Norman I'll notify him as to date of trial." Leroy told me after he come and left "Mr. McManus told me you and Brutus are Brother-in-Laws and your wife and Estelle (Brutus' wife) are sisters. No use of any trouble like that." . . . Leroy said "Tonight I will walk over there and see if he couldn't straighten matters out without going any further". . . I said, "Well I'll go as far as fields, but won't go to house." . . . I stopped in fields about 150 yards from house. . . .He was in Brutus' yard. Brutus was in front of his house. . . They stood in the yard a good while. I didn't hear what they said. . . Leroy walked to edge of yard. He said "Well, Brutus, I can't reason matters out will you. That'll be allright." Brutus said, "God Da you soul get out of my yards. Leroy said "That I'll be alright." Brutus then said "God Damn you, I'll shoot you." As he said that he rose to his feet and shot 4 or 5 times. Second shot Leroy fell. Leroy was not running during the shooting. . . I ran on home. Brutus hadn't seen me. I didn't go to his house. I went in my house. . . Leroy and I did not have a drink last night.
