Sam McCray, being duly sworn says: . . . I came in and heard my wife, Lucy McCrea crying and she told me that Herman Tadlock had beaten her twice that day and Herman was there sitting on the floor in my house. I told Herman to go on I would not bother him but would let the law attend to him about detain her. He left and came off to his house about one quarter of a mile. I went to Maxcy Rivers house to see about getting him to take me to Chesterfield and when I returned home, Herman came up in my yard toward Geo. Rushings and I met him in my yard and told him not to come into my yard by to go on, I did not want to bother him. He came toward me and brought out from under his coast one half gallon of liquor and drew back to throw it at me and I fired, hitting him in the face. I had a 12 gauge double barrel shot gun which you now have. I know that Herman Tadlock beat my wife, there are signs on her now. Herman did not say anything to me about beating my wife but told her that he did not beat her at all that day to what he was going to beat her if she didn't get her things out of that house.
