Thomas Farnely Sworn: Witness is a policeman in the town of Cheraw -- Said W. B. Cash come down Market Street; he passed deceased a step or two and then turned and asked Deceased if he was watching in. At firing of first shot deceased had his right hand in his pocket; at second shot he leaned over; at third shot he fell and his had came out from his pocket and his pistol dropped on the ground -- The three shots were fired in very quick Succession -- Saw a wound in Deceased on left side like a ball-hole.
