Dr. C. Kollock being duly sown says I was called to see Joe Malloy about nine o'clock last night the 24th and he was not quite dead but perfectly insensible, he was shot with the head evidently being one sided. . . I have examined the body of deceased since death and am satisfied he death was caused by the wound I have described. Could not from the range of the shot ben done by another person.
B. B. Funderburk being duly sworn says, The dawn of the storm Joe came by here and left his overcoat, and come back for his coat . . .and after staying awhile got his overcoat and he had a gun with him . . . a dog came up and jumped on his and Joe made a motion at the dog and the gun fired and Joe fell on his back the load in the gun taking effect in the side of his head no one near him when the gun fired when he motioned to the dog . . .
