J. R. Rallings being duly sworn says --that he walked up to the house of Ana Deason . . . heard words by Henry Blakeny of an angry nature. Thos Ingram asked him (Henry Blakeny) says well I can come out & he went out of the house & when out of the house I saw said Thos Ingram present his Pistol at him when about two steps apart and Dave Ingram & Frank Ingram said you torn & repeated it & at same time I saw Henry Blakeny trying to draw his pistol -- just at this time Thos Ingram shot Henry Blakeny & he said Henry Blakeny whiled & went into the house. I went into the house some five minutes afterward & he was dead . . .
