On Wednesday afternoon last Guss Dearing was pulling the slack off my enjine and Will Martin was pulling the tag line and there was another party down in the Hold pulling the block Guss told me to pull this man on the block up on the line and Martin told this man what Guss Dearing told me and Guss said to Martin you are a damned liar sir and Martin said you are a Dam son of-a-b. . . and Guss sid I will see you about this thing when we Knock off and after we knocked off Martin Came to me and asked if Guss told me to pull this fellow up on the line I told him he did Martin then turned around towards where Guss Dearing was and put his hand on his hip and said Guss don't you never cuss me any more Guss said damn you. I was standing in my enjine room and saw some parties running up this way & I ran also and when I got to the branch I saw Guss standing in the road that runs up by these houses with a pistol in his hand and I saw Wm McKie have Martin holding him up in his arms walking across the road and I ran up to where Martin was as I got there Jeff Shaw pulled Martins pistol out of his hip pocket
