Lewis Smallwood being sworn testified we was over in the cotton patch and we heard John Simpkins hollowing as thought he was bad off and we ran over to the house and when we got there or to the house I found him at the side of the house with his hands being through the crack hollowing like he was bad of and I asked him how did he doo he never gave me any answer I ran round to the front door and I did not see his wife I cracked the door I never saw any one but John Simpkins at the back door hollowing after that I cracked the door and Still I did not see Margaret Simpkins I then ran out doors did not Margaret Simpkins at that time John S motioned his hand to me and I ran back into the House and looked all around and he motioned his hand towards the bed [???] I ran in and saw her on the bed She was covered up near to the neck

I said to him John tell me how that was done was Margaret on the bed with you when she was Shot he says yes She was on the bed right under the bend of my legs [??] when the gun fired I asked him if he saw any one and he said he did not I asked him if he heard any one talking and he said he did not I asked him if any one went out of the House [?] that I know of his Brother Said John you must have had your head covered up he said no he did not I then asked him if the doors were [?] when the alarm was made he said no both doors were shut on the inside Margaret did not kill her self and I don't want you all to think if[?] Some one else Killed her and I don't know who it was he has on previous occasions talked to me in regard to his wife & children supposing if he was to die what would become of them

John Simpkins being sworn testifies I don't know how she Margt S[?] come dead I could not tell any thing about it did not hear the report of the gun I was in the bed I was frightened that [?] to make the alarm I did not Know what it was that frightened me I did not see any one in the house the last time I saw Margaret She was doctoring on[?] she said she could do something that would make me make water I found out that she was dead she was on the bed when I found it out I saw the blood
