Mrs Margaret Payne wife of B.F. Payne sayth on the 18th Inst S.B. Chappell rode into the yard of B.F. Payne called for Mr Payne and at first spoke friendly Mr Payne also spoke in a friendly manner and ask him to alight he did not alight but commenced cursing Mr Payne and said that he intended to kill him at the same time pointing a Pistol at Mr Payne that Chappell cursed her Mrs Payne who was standing in the door of the house he then jumped off his horse called two freedman Bill Chappell and Allen Smith to his assistance made towards Mr Payne said freedman being in the employ of Mr Chappel and one armed with a double Barrel shot gun they both ran into the yard from the gate some thirty yards and Mr Chappel made towards Mr Payne he shot with his Pistol twice and that Mr Payne was shot through the thigh ... Mr PayneMr Payne told him that he was unarmed when he first commenced threating him and before he alighted from his horse he Payne told him Chappel that he would fight a fair fight at any other time and place he rushed towards Mr Payne when they come in contact Mr Chappel shot twice as above stated there were other shots fired afterwards but in the confusion she does not actuly know who fired the shots as they were fired in the scuffle
