his hands were covering corn this boy the deceased Henry was missing from the field we remained in the field some two hours before his Return, upon being questioned as to where he had been all the time, the deceased answer just had been over the fence, and had lain down and dropped to sleep, and made excuse of being unwell. Mr Glover told him to come out one side and he would cure him, the boy instead of obeying ran off, Mr Arthur Glover followed and soon overtook him, and then took out his knife and cut a small place in each ear, (having previously told the deceased that if he ever ran off from him again he should mark him) Mr Glover told him to strip and the deceased ran off again, some twenty yards before Mr Glover overtook him. Mr Arthur Glover when he overtook him the second time, hit him some two or three licks, with his fist on his nose and face-he then tied him, with the assistance of another negro and myself, the deceased struggling all the while to get away, after the deceased was tied Mr Arthur Glover whipped him with a medium size cow hide, continued some time whipping at intervals, he also made a negro man whip him the deceased, but standing by all the time directing the negro man not to whip too hard, gave the caution several times not to whip too hard (the deceased was only tied by his hands and the rope[?] held in Mr Arthurs Glover's hands after some time I walked away some fifty yards to the other hands in the field and before going the deceased asked to have some water to drink, on my return Mr Glover had let him go to the water and he was there drinking, I cautioned Mr Glover not to let him drink much, he had been whipped but little. Before I returned from the hands the most of his whipping was given afterwards ... I have seen negroes whipped much severer than the deceased was whipped, and had no thought it could result in death

Dr M. W. Abney ... I am of opinion that the deceased came to his death from some other cause than wounds received in the whipping. A person in a heated condition drinking an overdraught of water might die suddenly in a very few hours
