Witness ... sayeth that he saw nothing of the death of the Decd the witness says he & Busbay was sitting in the Peaser[?] David Jeter was sitting in the door David Jeter commenced a chat with his mother saying his mother treated busbay better than she did him his David Jeters Mothers Reply was something concerning the woman David had married not standing as fare in society as other women, then david said that he had done as well as Laura, wife of busby, then Davids sister Louisa[?] said none of the busbys had ever had a bastard child. Then David Jeter cursed busby & talked about whipping of him & started off, Busbay said he expected some day he busby would be whipped but it never had been done yet, Busbay then cursed David Jeter witness does not know whether David Jeter herd him or not Jeter was then out of sight of witness. David Jeter banters[?] busbay out in the yard busbay then rose up jumped in the yard & Commenced pulling of his X for some of the busbays had bastard children. Coat[?] as he went busbay went out of sight of witness witness then herd the Report of a gun witness then went out & on his way to busbay saw busbays vest lying in the yard witness met busbay with his wife & her sister one on each side of him they busbay wife & her sister said he busbay was shot. Witness says if busbay spoke he dose not recollect it. Witness Passed[?] bubay & went to David Jeter & said to him he had shot busbay he David Jeter says I cannot help it for I did not know but that he would shoot me witness. Returned to the house busbay was not then dead but died in the course of half an hour. Witness says when he Returned to the House the Blood was running from the wounds. Witness says he never[?] saw any weapons in possession of busbay when he went out in the yard

The Evidence of Mrs. Sarah Jeter ... David Jeter her son came in the door & Commenced Talking with witness saying that she treated Busbay better than she did him witness Reply was if she had he deserved it David Jeter spoke & toald Busbay about his disappated Father & then Decsd toald him about his David Jeters wife sayin that she was no account & that she Davids wife had no character. Witness says the Decsd Caled David Jeter a Damed Dog saying that he Decsd had taken a great many things & he would no stand it any Longer
