Daphne belonging to John Boykin called & examined. About day light last Sunday morning, Dick waked me and squeezed my hand until I wake. He said to me why did not I go and lay down. I told him I was not agwine to lay down. He said what make I would not go and lie down, I told him again that I was not qwine to lay down. He told me I drive him and would not have him to come to the house. I told him I did not drive him he drive himself. I said to him now go. Master don't want you here and I don't want you here. He then said to me after you won't let me stay here, old man Jim shant stay here neither. Jim was laying down on a long bench fast asleep with his hands on his breast. I seed him asleep cause I knowed he was; Dick said that since I drive him he must go and he come out of the room and left me in the room. He then went to the hearth near where Jim was asleep. I saw him stoop down in the hearth and took up one of the chunks? That was burnt and and had fire on it at the time he was shaking it about in the hearth. He throwed the chunk back in the hearth, and then he wheeled out of the hearth and said he must go, and I thought he was going, but he did not go until he knocked Uncle Jim. I am certain that Dick knowcked Uncle Jim, but I do not know what he knocked him with; I heard him when he first struck Uncle Jim, and I was in the room and got up to come out to where he was, he struck the last lick when I got most to him so that I saw that he struck the lick and kept right on out of the house. I came straight out following Dick and I heard Dick say I'll be damned if ain't done; I then went to my sister's house (her name is Lucy) and called her up. I said Lucy come here to me for God Almighty's sake for here is trouble. I could tell her what sort of trouble till after it. Lucy went with me to my house; when we got to my house I hade her make up the fire. I then went to the door and met my brother Sam. He said sister what is the matter? I said, oh, budder, there is murder. I was then able to go to Uncle Jim. We lifted him up bodily and made Lucy get a tub of water and wash his face. Uncle Jim did not speak till I made a pallet and laid him down. He then said Oh! Lordy who did me so. Lucy said to him it was Dick, and he asked if it was Sam? Sam and Jim had never had any quarrel that I know of. Dick went and stood on the Rail Road near my house and I heard him say, Yes I ruined him and I will ruin many more.

Lucky belonging to John Boykin called and examined. Last Sunday morning about half an hour before day break, I was asleep when my sister came and called me, and told me to get up and said she was in a very big trouble. I asked her what was it and she said Dick had most killed the old man Jim. I jumped up and called my brother Sam Jesse, then he went right on to sister's house. I went too. He went in before me and looked at the old man and stepped back to the door and told me to come and get water and wash him. I went right straight and got the water and came and washed him. He asked me who was dat and I said me, Lucy. He then told me I must go and call my master, so I sent my brother Sam right after Mr. Huggins. I did not see Dick till he spoke he was then on the Rail Road. I heard Dick make answer to my brother Sam, Yes, damn him, I ruined him and I will ruin many more of them. Dick belongs to Mass Wm. Sanders; he never had any quarrel with the old man since he been on the plantation.

Sam belonging to John Boykin called and examined. Last Sunday morning, near day break, sister Daphne came to my house and called me; she told me I must get up, damage was going on in the plantation. I did not see Dick till I heard him speak. He said "yes G-d damn him. I ruined him and I will ruin many more before he stop coming here. I then went to within about twenty yards of him; it was then day light enough for me to see that it was Dick; he walked off and I broke and run after him but did not catch up with him. When he saw me running after him he changed his course, jumped the fence and went through the gate; I saw no more of him since he had nothing in his hands when I saw him, he had both hands in his coat pockets. Jim and Dick never had any quarrel to my knowledge.
