Thos. P. Meckley sworn, says that on yesterday immediately before the occurrence took place some ploughmen commencing working in Aleck's task, Aleck remarking to the negroes who were working near him that they might plough it up but he would not replant. I approaching him and told him that I would require of him to replant his task as well as hoe it, and if he did not I would flog him as well as if he had not hoed it. Aleck replied that it would take him until night to hoe his task. I ordered him to stop talking or I would flog him on the spot. He stopped talking until I went up to where some hands were working. I then heard him say that if I wanted it planting I ought send some one on tomorrow. I then rode back to him within a distance of fifteen yards and dismounted, telling him that I should flog him. He replied to me that I could not do it. I told him I would shoot him. He said, shoot. I immediately fired, aiming so that but a few shot should take effect in his right leg. The gun was charged with squirrel shot. One or two shot took effect in the right leg near the ancle. He Aleck then said, you see you have shot me and I don't care for your gun, repeating the same very often. I then reloaded my gun with the [intention] of shooting him again so that I might effectually disable him & without the intention of killing him. I then ordered him to lay his hoe down. He said he would not and would go to his master. I told him to go, upon reflection I had concluded it best that he should do so, and informed him where the bateau might be found, so that he might cross the river to where his master was. He continued hoeing in his task and I strode off for the purpose of meeting him at the place where his master was, after having gone about eight paces I heard him coming in a run. I turned half around and saw him within a few feet of me. I immediately fired both barrels of my gun, without bringing it to the shoulder. Aleck immediately fell to the ground, both charges having taken effect in the abdomen near the navel. I fired both barrels because after firing the first he Aleck did not fall. Witness says that from the known character of Aleck and from his having on previous occasion made an attack on him he in this occasion apprehended danger from him. Thos. Mickle

Dr. W.J. McKain being sworn says that he has examined the wounds on the body of the slave Aleck now dead and believes them to have been made in the manner and by the means stated in the evidence of Thos. P. Mickle.
