Do say upon their oaths from the evidence of Henry Schrock and Wm. Peebles being witnesses duly sworn say on the night of 22 Instant a hog was stolen out of the pen of Mr. Schrock and in the morning 23d Henry Schrock finding said hog gone and blood at the pen they went or sent for Wm. Peebles and they pursued on the trail till they found said black man at camp and he made off and said Henry Schrock told him to stop several times or he would shoot him but he would not and he the said Henry fired at him with an intention of shooting him in the legs but by chance seventeen low mold shot took him in the body of which wound he instantly died. And so the jurors upon their oaths say that the aforesaid Henry Schrock ... unintentionally did kill and murder against the peace of this state.
