one Poole Croft committed and assault with deadly weapon and with intent to kill by firing a loaded pistol at one William Gaillard[?], said Gaillard a conductor in the employ of the Greenville & Columbia R.R. Co and at the time of said shooting was in charge of a train as such

we came with a warrant to arrest Poole Croft ... we first found Poole Croft in the Cotton Patch of Carksdale Church. We first passed him by and went to the Blacksmith shop and learned there that he was the man that passed passed in the Cotton Patch ... I saw the man in the yard run off behind one of the houses in the yard and got out of my site. I then heard Jeff Gilreath say come one and I jumped on my horse and rode around the field ... Poole Croft was running and coming toward me. I called to him to hault ... I heard Gilreath calling to Croft to halt all along. So we had or three times. I heard the pistol fire again and on looking around I saw Croft on the fence and it appeared as if Gilreath was trying to pull him back. I did not see him fall. I then went to where they were & saw Croft laying dead.
