Frank Nelson was in my house eating his breakfast Henry Blassingham came in and asked Frank Nelson what he struck his wife for yesterday. Nelson did not say anything to him. Blassingham was standing right near him with a stick in his hand and said he had come to whip him and that he intended to kill Nelson or Nelson should kill him and then struck Nelson in the head with the stick. Nelson was still sitting at the table. After Nelson was struck he got up and Blassingham stepped out and drew his stick and started to strike again and Frank Nelson shot him with pistol. Frank Nelson told Henry Blassingham to go off and he said he would not. Nelson had the pistol in his pocket. He shot twice.

Mary L Nelson sworn says. . .On yesterday I had a difficulty with Adaline Blassingham the wife of the deceased. She passed by my door and I spoke to her about her abusing my children and she called me a damn liar. I told her to mind how she talked to me that my brother was lying[?] there and she said damn you and your brother too. Frank Nelson then got up and went out and told her she should not talk to me that way and she cursed him for a being[?] son of a bitch and I told him not to take it and then she went on but she came back and he asked her about it and she denied it. Frank Nelson took hold of her and I told him to hit her once for me and he struck her three times with his fist and then let her loose. I did not see anything more of her.
