Evidence of Negro Jerry. He states that negro Titus was here and did not say any thing to Frank and Frank made at Titus. Titus moved briskly in order to go home. Frank pursued him and struck at Titus but this witness does not know whether Frank hit Titus or not but Titus turned around and made a lounge at Frank. It being night this witness could not see what instrument he struck him with but Frank sunk down and soon expired. After he died this witness saw he was stabbed int he thing with some sharp instrument which produced his death. Frank said he was stabbed.

Evidence of negro Sampson. He states that negro Frank came and said good evening and inquired who was here and Titus said he was. Titus was leaning on the fence peaceable. Frank went in the house and got his stick he made at Titus. Titus was walking on towards home. Frank struck at Titus but he does not know whether he hit him or not as it was night.
