FIRST WITNESS: Frances Davis, duly sworn, testified as follows: . . . I heard the car when it hit. I wasn't going very fast. Had just pulled off from the stop. I didn't see the car when it hit the child. I got out of the bus and walked back. I went to the car and looked at it. The child's father came and picked the child up out of the ditch.
SECOND WITNESS: Thomas Capers, duly sworn, testified as follows: . . . We were on our way home. I looked down the road and discovered the bus. We were driving about 25 or 30 miles per hour. I picked up my cigar and started to light it. When I looked up I discovered something right in front of the ca. I couldn't imagine what it was. It was just a few steps in front of the car. . . She was right in front of the car when I first discovered her. . .Q. Had you been drinking? A. No
FOURTH WITNESS, Thomas Ford, duly sworn, testified as follows: . . . Q. What did William Anders do? A. He didn't do anything. I said to him, "Don't you see you done killed my child. He said it couldn't be helped. I told him couldn't be helped nothing. It looked like he tried to come up in the edge of the drive and hit her. . . Q. Could you tell if they were drinking? A. I couldn't tell too much about the driver. The other guy was drinking. I couldn't get close enough to the driver. . . Q. How old was she? A. 7 years old . . .
