I. P. Brown, who being duly sworn says . . . he was traveling No I highway in Chesterfield Count between Middendorf, S. C. and Patrick, S. C. going toward Partick, S. C. driving a Ford touring car and after he had passed the Hightower house he came to a medium steep grade and he noticed in front of him three persons walking near the center of the road. The deponent was driving on his side of the road being the left side of the road and deponent pulled his car still to the left trying to drive around the three persons. As he did so, all unexpectedly to the deponent, the said three persons went to the said left side of the road immediately in front of the car of deponent. And the car of deponent unavoidably ran into them. . .
