George F. Little being sworn, saith that he was present at the time a fight took place between W.A. Rose & W.S. Rogers which resulted in the death of the latter W.A. Rogers was keeping a retail Liquor shop in the town of Clinton & was in his place of business when the fight occured. Said Rose was in the act of setting out a Decanter of liquor when he (Rose) made the remark to said W.S. Rogers that he was a dmned sorry man. Upon hering [sic] the remark Rogers said that if he (Rose) should make use of the remark again he (Rogers) would hit him, when Rose made use of the same remark again, Rogers then took up the Decanter from the Counter, and threw it at Rose which Rose managed to dodge. Rose then took up another Decanter, & threw it at Rogers, which struck Rogers on the head. After he (Rogers) was struck, he made at Rose, and got to him behind the counter, when Rose took up a mettle Pitcher and struck Rogers several times over the head...
