R.L. Foley, sworn says yesterday about 3 or 4 oclock, I was told Jno Stevens had thrown the baby out of the house and about killed it I found a bruise on the head, I though the skull was broken, the mother of the child was not here. I asked the little boy what did it with, he said a hoe, he brought it out (The hoe shown to the Jury), he said a little girl Julie... told him to do it. The child died in a few minutes After I got here, It is 7 or 8 months old. Jno, that killed the child is four years old.
