2. Witness George B. Wilson, sworn says, he came out of Isaac Lewis's Store, saw Joseph J. Rollins with a short stick in his hand saw Rollins turn around, Bertell said to Rollins, I am not afraid of you Com on, or words to that affect. He walked around Joseph C. Bridger, and said to Bridger stop it, he said to Rollins, go back and dont do so, Rollins, then stabed at him and J. H. Norman. Rollins turned around and made at Pertell, again, Pertell retreated fending off Rollins licks, at that time Ja.s M. Bell came up and caught Rollins by the arm, Rollins then stabed Bell in the arm, Rollins stabed at several other persons as he went, Rollins returned with a stick and a Knife in his ahnds, struck at Pertell with his stick, Pertell struck Rollins with a stick--Rollins made at Pertell, who retreated triped and stagard, Rollins stabed Pertell with the Knife in the back, drew it back and stabed a second time, they both fell, said to Bridger, take away the Knife. Pertell raised upon his feet and then fell and expired.
