H.S. Allen Sworn Says, He was running the engine, No 737 on the 30th day of May, that left side track at Freight Deport about 625 and that he had to his engine one flat car and two shanty cars and that he was backing the flat car was in rear proper but as he was backing it was in the front the shanty cars was in the rear of the engine as they were backing but would have been in front if they had not been backing - he sounded the whistle for the road crossing at the signal post. Mr How[?] and the fireman commenced ringing the bell at the signal post, and continued to ring it untill after the man was struck, the flat car was what first struck him, says that he was leaving the deport to go to the tank for water and that he looked over the tender and saw the man in front about thrirty feet distant he blew the danger whistle or cattle alarm and the the man about that time passed out of his sight and that he called to his fireman who was at the back to look out, the bell was still ringing for the crossing and he then felt a quiver of the Engine, and he knew that he had run over something. the whole train ran over him, and that he stoped as soon as he could, that he reversed his engine, he dont think that he was running over ten or twelve miles per hour. Witness says that his train was a work extra, and that he had the same rights as the regular freight trains in regard to speed their maxam [sic] is twenty four miles per hour, witness is satisfied that the deceased had just steped upon the track when he first saw him, Witness says that he is an engineer and has been running on this road for several years, and that he did every thing he could do to prevent the accident, and that it happened near the Frieght depot in Winnsboro the 30 of May.
