[?] Pearson being Sworn States that Rock Pearson was at her house on Sunday the 6th inst. About 12 Oclock [?] Rock said he was inwell with pain in his side & had a cough he left there on his way to Tom Harris' on broad river where he lived. Cain Hamilton being sworn States, Rock Pearson was at his house on Sunday the 6th Jany 1878 about dark. said he was on his way home on broad river at Tom Harris' witness says he sent his son with a light to assist deceased over the Creek, when his son left him, gave him the torch & says he saw said Rock with the light on his way going towards G.B. Pearsons dwelling. Janice[?] McGill being Sworn. Testifies his little son with some negro boys were near the Creek hunting rabbits, the dogs bayed[?] something they went to the dogs and discovered a dead man they reported to witness, he went and found Rock Pearson lying in a ditch, his face partially covered in mud and water, witness called in his hands and had deceased moved to G.B. Pearsons, witness has no doubt the deceased was frozen to death being near Eighty years of age, slipped in the ditch & not able to get out. the weather being very cold frozed to death.
