E.P. Mobly sworn says I was hear [sic] when Frank Young & Charles Mobly went in washing Frank Young asked me to let him and Charley go in washing I told them they could go in at dinner time I forgot to let them go at the time I promised to let them go I recolected [sic] telling them they could go in swimming I then told Charley they could go swimming and I called Frank Young and told him if he wanted he could go in swimming he came an he Charley and myself went to the branch or Creak [sic] near my house say fifty yards off Frank stipped off and went in swam to a tree & stopped holding to it Charly then went in swam nearly to where Frank Young was and went down I saw he was drowning Frank let loose the tree, and also went down I jumped in to save them having clothes all on I having Charly out and in that time Frank Young had sunk and rose no more he was under water about three hours
