S. G. Barkley Sworn Makes oath that he saw the boy lying on his face near Mr Johnstons house in Winnsboro upon the ground, considered him dead at the time, which was about 10 O, Clock on the night of the 16th inst. All appearances indicating that he had fallen instantly[crossed out] dead suddenly January 17th 1848 Dr. H. I. Neil Sworn States that upon examination of the body he finds a slight wound near the left eye on the upper part of the jaw, but does not think it the cause of the death of the negro man. He is of opinion that said negro came to his death by a dispensation of Providence I[or J?] B McCall [?] Sworn States that the negro man was his property his name Hardy, that the said negro was not addicted to habit of intemperance, but was of sober & quiet habit, Saw the said negro on Tuesday last at which time he was sick, that he believes he had suffered from appoplexy the day previous Eliza Colored Girl belonging to Miss Crawford States that She found the negro man lying on the street near Mr Johnstons house about half past 9 O Clock on the night of the 16th inst. supposed he was drunk, did not recognize him, called for help to raise him up, that Washington Colored boy of Mr Clarks raised him up when he fell back as though dead. Saw no man upon the Street but said Washington. Phoebe[?] colored girl of Mr Johnston states that the negro man Hardy raped her about 5 minutes past 9 O Clock at her masters gate, about 15 minutes after, she heard that said Hardy was dead, went into the Street and found the body lying about forty yards from said gate, that said Washington & a negro man Noah belonging to David Aiken, were examining the body, Saw a Knife but it was not open. Betty belonging to Mr Johnston States that she was acquainted with said boy Hardy, Saw him on Sunday afternoon 16th inst. was well. A few minutes after 9 OClock was called near Mr Johnstons house to see said Hardy and when she examined the body she pronounced him dead. Saw no one near there but Said Washington and Eliza former witnesses Washington belonging to Mr C. Clarke States that he in company with said Eliza and Betty were on the Street near Mr Johnstons on Sunday night the 16th January 1848, foundl ying upon the street the said negro man Hardy, supposed him dead or dying saw no one near, no mark of violence or appearnace of Murder, went immediately for assistance to take charge of the body, that he and several others placed the body in a wagon that he accompanied the wagon to Mr McCalls Bill belonging to Mr. S.G. Barkley States that he and said boy Hard left Mr. McCalls about 10 Minutes before 9 OClock parted with him a few steps from the House, went on home and immediately or a few minutes after his arrival was informed that Hardy was dead, went out into the Street and found him lying dead about forty yards from Mr Johnstons gate, assisted in placing it in a wagon, saw nothing indicating violence about or near the place
