Saml M. Lathan Sworn Saith that he was on the plantation of John Lowry Decd[?] on Saturday the 26th Inst and he was told by one of the Negroes that Wm L. Galloway had Killed Bacchus- and afterwards Mr. Galloway told him that he the Sd galloway was about to Chastise Sd Bacchus and he Refused to Submit- he then Struck the Said Bacchus with the Lash of his whip- and the Negroe caught the Whip- and at the Same time caught him the Said Galloway by the Collar- he then Broke him down, and afterwards Struck him with the but end of his whip afterwards Mr. Lathan Saw the Negro- he was dead when he first Saw him- some blood was coming[?] from one of his nostrils- it was but a Short time after he first got the Information of the Negroes death before he saw the Negro perhaps 10 or 15 minutes- Galloway did not deny and[?] that he had Struck the Negro- Mr Galloway left the plantation Immediately Carrying a Loaded Pistol away with him- Mr Galloway told Mr. Lathan that he would Return next day about 10 oclock- and he forbid the Negroes to bury Sd Bacchus until he would Return
